Civilian Volunteer Service Reserve Act and the Posse Comitatus Act
If you watched the State of the Union Address last night you may have heard this bit towards the end from Pres. Bush. Pay attention to the underlined portions:

In a nutshell what Bush spoke of is the creation of a mercenary army that DO NOT abide by the established rules for the Military. You get a set of untrained (or barely trained) civilians to wreak havoc, thus bypassing the Geneva convention, and causing "terror" among the Persians, and later, among the Arabs. Bush can't legally take responsibility, as he isn't commanding an army, but just allowing "citizens" to do whatever "is necessary." I hate to use a TV show as a worse-case scenario but if you've been watching the show Jericho lately that is the exact situation we're headed towards. Which leads me to the Posse Comitatus Act. For those that don't know about this little obscure law (shame on you) you can find the full text of the act at this link. The Posse Comitatus Act at it's core is designed to prevent the Federal government from using Federal troops as a police force. This is why Military Police only have jurisdiction over Military personnel and will never pull our civilian butts over for speeding, running a red light and so on. However with the creation of a "civilian service reserve" a loophole is created making Posse Comitatus moot. Following the letter of the law the Federal government cannot send Federal troops into civilian situations; a Civilian Service Reserve bypasses this entirely. Since they are classified as "civilian volunteers" they are not considered Federal troops and as a result are not held accountable by Posse Comitatus. It's easy to see where the path leads from there. Mercenary troops answerable only to the monied or corporations with little to no accountability under the law. Good night and good luck. |
